Terms of Service

1. About Planeer
Planeer (“we”, “us”, “our”) is an AI-powered planning intelligence platform operated by David Kennedy, Jersey, Channel Islands. The platform provides automated analysis of planning policy and precedent data to assist users in understanding planning potential for properties. Planeer is not a regulated planning consultancy.
2. Eligibility and Account
You must be at least 18 years old to use Planeer. By using the service, you represent that you meet this requirement and that the information you provide is accurate and complete.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@planeer.ai if you suspect unauthorised access.
3. The Service
Subject to these Terms and payment of applicable fees, Planeer grants you a non-exclusive, non-transferable licence to access and use the platform for the purpose of obtaining AI-generated planning analysis for properties in supported jurisdictions.
The service includes, depending on the plan purchased:
- –Property search and constraint overview
- –AI-generated planning option analysis with approval probability scores
- –Citation of relevant planning policies and precedent applications
- –Draft planning application documents (planning statement, design statement, application form)
All outputs are AI-generated and subject to the limitations described in our AI Analysis Disclaimer, which forms part of these Terms.
4. Fees and Payment
Fees for analysis reports and application packs are displayed on the platform at the point of purchase. All prices are inclusive of applicable taxes unless stated otherwise. Payment is due in full before analysis is delivered.
Refunds: Due to the automated nature of the service, we are unable to offer refunds once an analysis has been initiated. If you experience a technical fault that prevents delivery of your report, contact us and we will investigate and either re-deliver or provide a credit.
5. Acceptable Use
You agree not to:
- –Use the platform for any unlawful purpose or in any way that violates applicable laws
- –Submit false, misleading, or fraudulent information
- –Attempt to reverse-engineer, scrape, or systematically extract data from the platform
- –Use automated tools to access the platform without our prior written consent
- –Resell, sublicense, or distribute outputs commercially without our written consent
- –Impersonate any person or entity or misrepresent your affiliation with any person or entity
- –Introduce malicious code, viruses, or other harmful content
- –Use the service to harass, harm, or discriminate against any person
We reserve the right to suspend or terminate access for breach of these conditions without notice.
6. Intellectual Property
All rights in the Planeer platform, including its design, software, trademarks, and underlying AI models, remain the property of Planeer. These Terms do not grant you any intellectual property rights in the platform itself.
Reports and analysis documents generated for you are licensed to you for your personal or internal business use. You may not resell or distribute them as a commercial service without our written consent.
Data you submit to the platform (property addresses, queries) remains yours. By submitting it, you grant us a licence to process it to provide the service and, in anonymised form, to improve our AI models.
7. Disclaimer of Warranties
The Planeer service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that:
- –The service will be uninterrupted, error-free, or secure
- –Any analysis, report, or probability score is accurate, complete, or fit for any particular purpose
- –The service will meet your specific planning requirements
- –Any planning application prepared using our outputs will be approved
8. Limitation of Liability
To the fullest extent permitted by law, Planeer's total liability to you for all claims arising from or related to these Terms or use of the service shall not exceed the total fees paid by you to Planeer in the three months preceding the event giving rise to the claim.
We shall not be liable for any indirect, consequential, special, incidental, or punitive damages, including loss of profits, loss of data, or loss arising from a planning decision, even if we have been advised of the possibility of such damages.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
9. Third-Party Services
The platform may contain links to third-party websites or integrate third-party services. We are not responsible for the content, privacy practices, or terms of those services. Your use of third-party services is governed by their own terms.
10. Changes to the Service
We may modify, suspend, or discontinue any part of the service at any time. We will provide reasonable notice where practicable. We may also update these Terms; continued use of the service after changes take effect constitutes your acceptance of the revised Terms.
11. Termination
Either party may terminate your account at any time. We may suspend or terminate access immediately if you breach these Terms. On termination, your right to use the service ceases. Sections 6 (IP), 7 (Warranties), 8 (Liability), and 12 (Governing Law) survive termination.
12. Governing Law and Disputes
These Terms are governed by the laws of Jersey, Channel Islands. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the Royal Court of Jersey, except where mandatory consumer protection laws in your country of residence require otherwise.
